Re: Imperial v. Dellanno



Dear Mr. Rubenstein:


I am in receipt of your letter dated September 9, 1999 advising me that your client, Cafe Dellanno (Anthony Dellanno) intended to vacate the premises on or about September 15, 1999.

As of this date Mr. Dellanno has not removed the contents on the premises. Remaining are tables, chairs, counters, sinks, refridgeration cases, gas appliances, papergoods and various coffee making and food preparation equipment.

As Mr. Dellanno did not communicate with me at all until September 24, 1999, I have had new locks installed. A key has been available to him from K C Cleaners in the rear of the building for the purpose of removing all the contents and restoring the premises to its original condition. Mr Dellanno has been aware of this.

Please be advised that if the contents described above are not removed from the premises by September 30, 1999, I shall consider them as abandoned and take steps to sell or otherwise dispose of them.

As you suggest in your letter, I would like to meet with you and your client to discuss the costs in excess of the security deposit to cover the loss of rent and plumbing to remove the sinks and gas appliances as well as the electical and carpentry cost to restore the premises.
