The next Wantage Township Mayor & Committee Meeting is Thursday, August 12, 2010, 7:00pm at the Wantage Municipal Building, 888 Route 23, Wantage, NJ 07461.

6/29/10 - The Motion for Reconsideration was filed.

6/25/10 - Mayor Nuss has confirmed that the Court Order was received on 6/10/10.

6/24/10 Wantage Township Mayor & Committee Meeting:
During the Open Public Session many members of the public implored the Mayor & Committee to appeal Judge Bozonelis' decision. Michael Garofalo, Township Attorney, advised those present that the Township had until 7/20/10 to appeal the Judge's decision. After listening to & accepting written public input during the Open Public Session, the Mayor & Committee closed the Open Public Session and adjourned to Executive Session. After emerging from Executive Session, Mayor Clara Nuss announced to the public present that the Township will seek Reconsideration of Judge B. Theodore Bozonelis' 5/14/10 decision.

6/10/10 Wantage Township Mayor & Committee Meeting:
During the Open Public Session, Christine Feoranzo, Wantage resident, submitted a written & oral statement to the Mayor & Committee suggesting that the Township of Wantage invoke eminent domain & assume full authority & ownership of Lake Neepaulin & its dam & beach lot due to the decades long dispute of the ownership & maintenance of the properties. Karen Merritt, Wantage resident, offered a brief history of the private ownership of Lake Neepaulin & its dam & beach & expressed the need for the Township to take ownership of Lake Neepaulin & its dam & beach lot. Mayor Clara Nuss asked Michael Garofalo, Township Attorney, if he wished to present the Attorney's Report, & he advised that the only item pending at this point would be if the governing body expressed a desire for an update regarding the issue of the Lake Neepaulin lawsuit and possible appeal options. The governing body indicated a desire to discuss this & entered into Executive Session. After meeting in closed Executive Session, the members of the governing body returned to Open Session, &, as there was no further business to discuss, the meeting was adjourned. As of Thursday, 6/10/10, the Township had not received the Court Order.

5/27/10 Wantage Township Mayor & Committee Meeting:
After listening to and accepting written public input during the Open Public Session of the 5/27/10 Township Meeting, the Mayor & Committee closed the Open Public Session and adjourned to Executive Session. After emerging from Executive Session, Mayor Clara Nuss announced to the public present that Michael Garofalo, Township Attorney, has advised the Committee that the Township has forty-five (45) days after receipt of the Court Order to file an appeal to Judge B. Theodore Bozonelis' 5/14/10 decision. Mayor Nuss also announced that the Township Commmittee will continue to review information in the interim. As of Thursday, 5/27/10, the Township had not received the Court Order.



Superior Court Judge B. Theodore Bozonelis' decision on Friday, May 14, 2010 effectively forces all New Jersey municipalities that have privately owned dams within their borders to forever indebt their taxpaying citizens to bear the financial burden of the repair, upkeep and maintenance of those privately owned dams.

If you are a New Jersey property owner and you disagree with this decision, YOU MUST ACT NOW. It is imperative that you:

- attend the meeting of the Mayor and Committee on Thursday, August 12, 2010 at 7:00pm at the Municipal Building, 888 Route 23, Wantage, NJ 07461 and implore the Mayor and Committee to immediately appeal Judge B. Theodore Bozonelis' decision to a higher court

- contact the Mayor and Committee via phone and regular mail and implore them to immediately appeal Judge B. Theodore Bozonelis' decision to a higher court.

It cannot be stressed enough that it is imperative for you to attend the next Township meeting and present your letter to the Mayor and Committee. If it is absolutely impossible for you to attend the meeting, please print and sign and date the letter; and, if you have the ability, scan your signed letter and send it via e-mail to our Township Committee or give your signed letter to a friend who will be attending the meeting who will present it for you.
